Requirements
- Juris Doctor (J.D.) degree from an accredited law school.
- Active license to practice law in a U.S. state.
- 5 to 10 years of legal experience with expertise in health and welfare benefits and ERISA fiduciary matters.
- Demonstrated success in vendor contract negotiation and management.
- Deep knowledge of ERISA, HIPAA, ACA, COBRA, and IRS regulations.
- Strong understanding of fiduciary responsibilities.
- Ability to analyze complex legal issues and communicate recommendations to business leaders.
- Strategic mindset with a practical, business-focused approach.
- Technical proficiency with Microsoft Office (Outlook, Word, Excel, PowerPoint) and collaboration tools (Teams, Zoom).
- In-house counsel experience focused on employee benefits preferred.
- Benefits litigation experience preferred.
- Experience with Ironclad contract management software preferred.
Responsibilities
- Negotiate and draft client, vendor, and partner contracts, including agreements with TPAs, PBMs, and insurance providers.
- Provide legal counsel on the design and administration of health and welfare benefit plans.
- Ensure compliance with ERISA, HIPAA, ACA, COBRA, and state insurance requirements.
- Draft and maintain plan documents, Summary Plan Descriptions (SPDs), and participant communications.
- Resolve benefits-related disputes, claims, and appeals, overseeing outside counsel as needed.
- Monitor legislative developments and implement updates to policies and practices.
- Support audits, Department of Labor investigations, and inquiries regarding contract and plan compliance.
- Educate internal stakeholders on fiduciary obligations and contract compliance.
