Requirements
- Bachelor's degree in Healthcare Administration, Public Health, Legal Studies, or a related field.
- 5+ years of healthcare compliance experience, preferably with MSO structures, physician groups, or telehealth companies.
- Deep understanding of Corporate Practice of Medicine doctrine, Anti-Kickback Statute, Stark Law, and HIPAA regulations.
- Experience with state-by-state healthcare regulatory variations and multi-state compliance.
- Track record conducting compliance audits and developing compliance programs.
- Strong understanding of Fair Market Value methodologies in healthcare arrangements.
- Proficiency with compliance management software, document management systems, and Excel.
- Master's degree in Healthcare Administration, Public Health, or a related field is preferred.
- CHC or CPCO certification is preferred.
- Telemedicine regulatory compliance and Ryan Haight Act experience are preferred.
- Experience with physician credentialing and state medical board regulations is preferred.
Responsibilities
- Monitor federal and state healthcare regulations affecting MSO structures, CPOM, Anti-Kickback, Stark Law, and telemedicine.
- Track OIG advisory opinions, CMS guidance, DEA regulations, state medical board updates, regulatory deadlines, license renewals, and credentialing requirements.
- Conduct quarterly audits of Brand Partner agreements, IMG structures, payment methodologies, and physician employment agreements.
- Review physician compensation for Fair Market Value and coordinate with independent third-party valuators.
- Audit payment flows for outcome-independent compensation and document safe harbor compliance for MSO arrangements.
- Maintain state-by-state compliance matrices and coordinate jurisdiction-specific questions with healthcare attorneys.
- Review Brand Partner Agreements, Management Services Agreements, and Business Associate Agreements for compliance.
- Oversee physician licensing and credentialing, DEA registrations, and medical malpractice insurance monitoring.
- Develop compliance guidance and onboarding training for Brand Partners, and investigate potential violations.
- Prepare quarterly compliance reports, maintain compliance metrics, and develop risk mitigation strategies.
